Attorney David J. Barton

Attorney David Barton is an Associate of Bentz Law Firm, P.C. Mr. Barton concentrates his practice in the representation of businesses, civil litigation, creditors’ rights and decedent’s estates. Attorney Barton has many years of experience in a closely held corporation and extensive involvement with both retail and wholesale leasing and financing. He regularly represents a number of companies in fields including construction and insurance.

Attorney Barton is admitted to practice before all Pennsylvania state and federal courts, and the United States Court of Appeals for the Third Circuit. His practice includes matters in federal and state trial and appellate courts, both locally and nationally.

Recently, Attorney Barton has:

Defended a national retail developer in premises liability litigation resulting in a settlement approaching seven figures from other tortfeasors with no payment from his client.

Obtained judgments against indemnitors in federal and state courts for sureties and, through execution proceedings, recovered substantial funds for sureties to offset their losses.

Advised and represented numerous individual executors and institutional fiduciaries in decedent’s estate matters including large estates with United States Estate Tax liabilities.

Tried cases for commercial, construction and surety clients in business litigation involving both trials, American Arbitration Association proceedings, and negotiated numerous settlements of complex construction matters.

Represented charitable trust beneficiaries in trust litigation and dissolution proceedings involving both negotiated settlements and Orphan’s Court trials in numerous southwestern Pennsylvania counties.

Counseled clients on municipal development, zoning and other complex real estate development issues in both commercial and residential settings, including completing subdivisions under the Pennsylvania Municipalities Planning Code. Additionally, Mr. Barton has regularly represented a national retailer in lease disputes throughout Pennsylvania, and has advised a national real estate developer in connection with the proposed rehabilitation of federally funded housing units involving private and public financing and equity investments.

Obtained and collected judgments for banks and other businesses in commercial transactions, using settlement agreements, and where necessary execution proceedings.

A graduate of Duquesne University School of Law (Juris Doctorate), Attorney Barton was a member of the DUQUESNE LAW REVIEW, the Justice Louis L. Manderino Honor Society, Appellate Moot Court Honor Society, and was recognized for his achievement when he competed in the American Bar Association’s National Appellate Advocacy Competition. He also holds a B.A. Degree in Public Policy from Tulane University.

In addition to his practice with the Bentz Law Firm, P.C., Attorney Barton has served as Magisterial District Judge in Allegheny County, Pennsylvania since 1996. After his initial appointment by then-Governor Tom Ridge and subsequent unanimous confirmation by the Senate of Pennsylvania, Mr. Barton was elected a member of the Pennsylvania Judiciary in 1997 and re-elected in 2003. He is an active member of the Special Court Judges Association of Pennsylvania and co-chairs a statewide legislative committee.
